A significant number of high-value international disputes have an Indian nexus. Even where parties choose to arbitrate outside India, Indian law frequently remains the governing law of their contracts.
For international disputes practitioners and parties, this can present challenges: Indian contract law has its own statutory framework and a substantial body of jurisprudence. Assumptions of similarity with English law, or the law of other common law jurisdictions, can be misleading.
Drawing on Tom Sebastian’s and Aman Ahluwalia’s recently published Fundamentals of Indian Contract Law (Cambridge University Press, 2026), and the panel’s collective experience of handling major disputes involving Indian parties, this session will explore how these issues arise in practice.
Rather than surveying Indian contract law in the abstract, the discussion will focus on the questions that matter when a dispute arises; when Indian law can produce different or unexpected answers; how those issues are best presented to international tribunals; and the practical lessons that can be drawn from significant India-related disputes.
The session will bring together leading practitioners to offer practical guidance on navigating disputes with an Indian nexus, illustrated by recent jurisprudence, real-world experience, and insights from this pathbreaking text.
