X v Mid-Sussex Citizens Advice Bureau and Another [2012] UKSC 59

The Supreme Court has recently upheld earlier rulings of the Employment Appeal Tribunal and the Court of Appeal that voluntary work does not fall within the concept of an “occupation” in Article 3(1)(a) of the EU Framework Directive on equal treatment in employment and occupation. Accordingly, X, a volunteer with the Citizens Advice Bureau, could not rely on the protection against discrimination on grounds of disability afforded by that Directive.
