R (on the application of ClientEarth) v. The Secretary of State for the Environment, Food and Rural Affairs [2013] UKSC 25

In these judicial review proceedings, ClientEarth challenged the UK’s draft air quality plans for reduction of levels of the air pollutant nitrogen dioxide. In addition, it sought a declaration that limit levels set out in EU legislation had been breached.

After hearing the submissions of the parties, the Supreme Court opted to refer to the CJEU a number of “difficult issues of European law” on which it found guidance was required.
