The judgement of the Court of Justice of the European Union (“CJEU”) in Kadi II, handed down on 18 July 2013, has been eagerly awaited by governments, practitioners and commentators alike. At its heart the case concerns the question of the level of deference the EU courts should pay to resolutions of the UN Security Council and as such it was always destined to be a high profile, and potentially controversial, decision.
