DESCRIPTION:This is an afternoon webinar on the Competition Appeal Tribuna
 l’s landmark judgment on pass-on in the Interchange Umbrella Proceedings
 .\n\nFollowing Trial 2 (November 2024 – April 2025)\, the Tribunal has c
 larified the legal principles governing pass-on both as a mitigation defen
 ce in direct claims and as an element of an indirect claim\, and the appro
 ach required to assess  pass-on on the evidence.\n\nIn the context of pro
 ceedings concerning multilateral interchange fees set by Visa and Masterca
 rd brought both by retailers and  consumers\, the Tribunal addressed pa
 ss-on at two levels of the supply chain:\n\n 	From acquiring banks to merc
 hants (holding that blended MIFs were passed on at 85%)\; and\n 	From merc
 hants to consumers (holding that defendants must prove a “direct causati
 ve link” between the overcharge and downstream prices\, which was largel
 y not established).\n\nThis session will examine the Tribunal’s reasonin
 g and the implications for competition damages claims and collective proce
